(Page 2) <br />MINE ID # OR PROSPECTING ID #: M_199a_nort <br />INSPECTION DATE: ~~inP 97 ~nn~ INSPECTOR=S INITIALS: A IW <br />OBSERVATIONS <br />This was a normal monitoring inspection conducted by Chris Rowe and Tony Waldron of DMG. The site is <br />located just north of 88~" Avenue and west of Monaco Street in Adams County. This inspection was conducted <br />to review and determine the status of an application (M-2002-092-Broda Pit) that was submitted for the eastern <br />portion of this pit (area 2c) and would have removed this section from the Dahlia North Resources Pit. The <br />reason for separating out this portion of the permit area was to allow backfilling of the existing lake in the Broda <br />Pit area using imported inert fill. The status of the Broda application is currently "Application under Review" and <br />a request was made by the applicant to suspend review of the application until he received the necessary <br />permits from Commerce City to operate an inert fill facility. No further contact has been made with our office <br />with respect to obtaining the necessary permits, however, it sounds like the applicant would like to withdraw <br />this application and pursue a release of this area from the existing Dahlia North Resources Pit. <br />There is evidence in the file that inspections have been conducted by the Colorado Department of Health and <br />Environment suggesting that approval for inert filling of this site was obtained. However, none of this <br />information has been submitted to our office from the permittee or Mr. Broda. It appears that the review was <br />suspended to allow the inert fill permitting to be completed. Once that was done, Aggregate Industries was <br />going to request an acreage release for this area. Unfortunately, it does not appear that the permit was ever <br />revised to clarify that this area would be used as an inert landfill. Apparently the site was going to be backfilled <br />with mine processing waste such as overburden and waste sand and revegetated or returned to farmland. <br />Since the permitting was never clarified with respect to how this area would be reclaimed, this is going to be <br />cited as a problem on page three of this report. The abatement will be to submit a technical revision to the <br />permit application clarifying what the post-mining land use will be for the Broda property. Existing <br />documentation clearly showing that this has been completed in the past may also be submitted in lieu of a <br />new technical revision. Once the post-mining land use for this area has been clarified and formalized, the <br />operator can pursue an acreage release for the Broda site. In addition, Mr. Broda can then officially request to <br />withdraw his permit application from consideration by DMG. <br />This concluded the inspection. <br />I & E Contact Address <br />NAME: Connie N.
