A "pace" estimate of the area of affected land measured*1,119 ft. by 4S0 ft., totaling <br />approximately 537,120 sq. ft., or approximately 12.3 acres. The site is permitted for 9.9 acres. <br />As pacing is a rough estimate, it is recommended that West End Gravel Company survey the site <br />by Apn17, 1997, weather permitting, to determine the actual aaeage of affected land. Please <br />review Rule 1.1(3) of the Construction Moterials Rules and Regulations of the Colorado Mined <br />Land Reclamation Board e11eciive Jamtary, 1996, for the definition of affected lands. Additional <br />~. Financial Warranty will need to provided for any acreage exeeding the currenlty permitted 9.9 <br />acres. <br />2. The site was posted with an entrance sign; boundary markers were easily identified. <br />3. Topsoil was well segregated and stockpiled in the northeast corner of the site. It was not <br />vegetated, however, and ezidbited minor evidence of erosion Mr. Enos indicated that the <br />Topsoil stockpr7e will be revegetated with the permitted revegetarion seed mix this coming Fall. <br />4. The Financial Warranty curremly held by the Office for this site is 56,000.00. All mine <br />sites in Colorado are required to be bonded for the actual cost of reclamation ii; in the case of <br />permit revocation and bond forfeitwe, the staze were to put the reclamation work out for <br />competitive bid. Attached to this report is a detailed estimate of the cost to reclaim this site based <br />on the approved mining and reclamation plans, and conditions observed during the inspection. <br />Pursuant to Rule 4.2.1(2), of the Rules and Regulations, Financial Warranty Review -the Office <br />tray, in its discretion, review any Fimancial Warranty for adequacy at any time. In the evem the <br />~ Office determines that the Firtanaal Warranty is insufficient to perform reclamation, the Operator <br />shall have up to sixty (60) days to post additional Financial Warranty from the date of written <br />notice from the Office of such ittsufficiency. If the operator disagrees with the Office's Notice to <br />Increase the Financial Warranty, the Office shall schedule the matter for a hearing before the <br />Board. <br />Please submit an additional 523,620.00 in Financial Warranty by May S, 1997. However, if the <br />site survey shows that the affected land exceeds the curremly permitted 9.9 acres, the additioanal <br />amount of Financial Warranty required will need to be recalculated. <br />
