III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This former underground mine was reclaimed and reseeded in 1996 and early <br />1997. Ground conditions on this day were generally dry and the weather was mild. <br />Revepetation <br />Vegetation is beginning to show signs of early growth for the season, although it appears to <br />early for significant growth, likely due to cool soil temperatures at this elevation. Reclaimed <br />areas where former sediment ponds 2, 3, 4 and 5 were located appear in good condition. As <br />per Rule 3.03.1(5), these reclaimed pond areas are not subject to the extended liability <br />period of Rule 3.02.3(2) or the bond release criteria of 3.02.1(2). Cattle were not observed <br />on, or near, the disturbed area. The fence around the reference area remains to be <br />repaired. <br />Development Waste <br />The development waste pile was traversed on foot. The outslope of the pile shows no sign <br />of erosion, slumping, or damage of any kind. <br />Overall, the site appeared in good condition for the late winter season. <br />
