III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. <br />Roads <br />The main paved haul road was in good condition. The guardrail was in place. The graveled road on the <br />east side of the loadout was also in good condition. The east side gate was open. The light use road <br />along the railroad tracks was muddy in spots but was passable. <br />Hydrology <br />The east side sediment pond had a standing water level about one foot below the primary discharge <br />pipe, the gated valve of which was closed. The pond embankment and inslopes were stable. The <br />emergency spillway was functional. The west side dugout pond was dry. The combination spillway <br />and riprap were functional as well. <br />Loadout site culverts were clear and the ditches had sufficient capacity. The straw bales and silt fence <br />were in place along the railroad track small area exemption. The railroad track culverts were <br />functional. <br />Topsoil Stockpiles <br />There were no erosional problems at the east and west topsoil stockpiles. Diversion ditches berms were <br />in place and the collection ditches were functioning properly. Topsoil signs were up. <br />Facilities <br />Coal was being loaded by front end loader into a coal haul truck during the inspection. No problems <br />with fugitive dust were observed. There was no evidence of coal on the main highway. <br />There were no leaks or other problems at the fuel facility. No problems were noted at the mine office <br />area, shop area, material storage area or at the loading facilities area. The berm on the outside edge of <br />the facilities bench was functional. <br />c:/word/tenor/insp0106 <br />
