III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was an aerial inspection conducted by Harry Ranney of the Colorado Division of <br />Reclamation, Mirnng. and Safety (Division). Kent Gorham of the Division reviewed oblique <br />aerial photographs in the office on January 19, 2007, A final bond release application ~s <br />currently under review for this site for all areas except 1.2 acres at the NW-1 ventilation shaft <br />area, Heavy snow blanketed the region due to numerous snow storms over the last month <br />The road through the <br />reclaimed area was <br />released under an <br />industrial land use for <br />coal bed methane <br />extraction Evidence <br />suggests that the road <br />was cleared of snow to <br />allow access to the <br />many gas well sites <br />south of the reclaimed <br />area. <br />One photograph <br />clearly shows a new <br />disturbance at the toe <br />of the development <br />waste pile, apparently <br />for a gas pipeline At <br />this point, disturbance <br />to the reclaimed area <br />has been avoided. <br />Nothing warranting on- <br />the-ground rspection <br />was noted in any of the <br />photographs taken <br />
