(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1999-120 <br />INSPECTION DATE 02/24/06 INSPECTOR'S INITIALS ESC <br />O83BRVATION3 <br />This was a surety reduction request inspection of the Fort Lupton Sand & Gravel Mine <br />conducted by Erica Crosby of the Colorado Division of Minerals and Geology. Lynn Mayer <br />Shulta, Richard Schneider and Jim Sittner of L.G. Everist, Znc. were present during the <br />inspection. <br />An 112c Mining and Reclamation Permit was issued to L.G. Everiat, Inc. on June 1, 2000, <br />for a total permit area of 78 acres. The permit was amended on February 10, 2005 that <br />increased the permit area to 290 acres. The Division holds a financial warranty in the <br />amount of $477,500.00. <br />The site is located 2 miles north west of Ft. Lupton in Weld County, Colorado. Amine <br />identification sign was posted at the entrance to the site. <br />L.G. Everiat submitted a surety reduction request (SR-O1) for the site on January 27, <br />2006. The operator completed the slurry wall liner around the original permitted area of <br />the site. A letter from the Office of the State Engineer (OSE) approving the construction <br />of the liner was submitted with SR-01. in conjunction with the surety reduction, the <br />operator also submitted a technical revision (TR-O1) to bond for the mining and <br />reclamation of the Golden Pit and the Hill-Oakley Pit previously approved under Amendment <br />O1 (AM-01). In these two phases, a slurry wall will be installed prior to mining and will <br />be reclaimed into water storage reservoirs. <br />A site inspection verified that the Blurry wall was completed in the original permit area <br />referred to on the maps as the Fort Lupton Weat and the Fort Lupton East Pite. According <br />to the operator, the slurry wall had to be installed twice due to failure of the slurry <br />wall during the original installation. Apparently, the slurry wall was not keyed in deep <br />enough to the underlying Pierre Shale bedrock. The operator demonstrated compliance of <br />the second slurry wall installation to the OSE using monitoring wells installed on site <br />and pumping tests. <br />The operator is currently mining in the east pit and will be completed within a few <br />months. The west pit has not yet been mined but is currently used for the stockpiling of <br />stockpiles and processing operations. <br />A slurry wall was actively being installed in the Golden pit immediately east of the Fort <br />Lupton East Pit. This area is identified under TR-O1. Slurry wall construction was noted <br />on the pit face adjacent to the South Platte River. The excavator digging the trench was <br />currently out of service during the inspection. According to the operator, the slurry <br />wall must be keyed into bedrock approximately 65 feet deep on the side adjacent to the <br />South Platte. The slurry wall will be ultimately be connected the to the Fort Lupton East <br />Pit slurry wall. The slurry wall will encompass an area approximately 34 acres in size <br />and be approximately 3,790 feet in length with an average to depth of bedrock at 50 feet. <br />The other parcel identified in TR-O1 to encompass a slurry wall ie the Hill-Oakley Pit. <br />The perimeter length of the slurry wall will be 5,354 feet with the average depth to <br />bedrock at 35 feet. The Eber portion of the property will not be mined at this time, but <br />will remain in the permit area for possible mining in the future. TR-O1 also identifies <br />an area on the Swingle South Pit that would be used to store stockpile materials <br />approximately 23 acres in size. <br />As a result of the inspection, the Division will approve the surety reduction request for <br />the slurry wall that is completed around the original permit area and approved by the SEO. <br />The original estimate for the slurry wall (at 208 cost) is $177,595.00 (based on 8,222 <br />lin.ft. * 36'deep). Therefore, the bond will be reduced to $299,905.00. However, with <br />the addition of slurry wall cost for the Hill-Oakley Pit and the Golden Pit under TR-O1, <br />the bond will be increased an additional $226,134.00 (based on 208 cost of the combined <br />area of 376,890 eq.ft. * $3.00 totals $1,130,670). The total bond for the site will be <br />set at $526,000.00. The Division currently holds $477,500.00, therefore, the operator <br />will need to post an additional bond of $48,500.00. <br />
