III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the erforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. The loadout site had very little snow on it but the azea was wet. <br />Roads <br />The main paved haul road was in very good condition. The operator has repaired the side drain area that had <br />some erosion. The east entrance road was in good condition as well. The east gate to the loadout was open. The <br />light use road along the railroad tracks was very muddy but passable. <br />Tonsoit <br />The east topsoil stockpile was moderately vegetated. The collection and diversion ditches were functional. The <br />west topsoil stockpile had moderate vegetative cover. The south-facing slope of the stockpile had been reseeded <br />and covered with mulch blankets last yeaz and the vegetative cover is coming up. <br />Hydrotopy <br />The culverts and ditches around the loadout area were functional. The railroad track SAE straw bales and silt <br />Fence were in place at the inlets to the railroad culverts. However, the silt fence around the railroad culvert near <br />the west pond will need repair soon. <br />The private irrigation ditch system along the west side of the permit azea was abandoned and a new irrigation <br />ditch was dug along the west end of the pemilt azea. The operator will need to seed this area soon. A half <br />culvert carries the irrigation water from the new ditch into a railroad culvert and to the other side of the tracks. <br />There was only a little water in the east pond. The pond embanlanent was well vegetated and appeared to be <br />stable. The pond inslopes were also stable. Spillways were functional. The west pond was cleaned out. The hill <br />slope neaz the dugout pond had a small slump in it. The area is too wet to work in now but repair work will need <br />to be performed eventually since additional slumping of the hill side may start to encroach on the dugout pond. <br />Signs and Mazkers <br />The mine ID signs were up at the appropriate locations. However, the county is reassigning street addresses so <br />the loadout address on themine ID signs and in the permit application will need to be changed. Permit boundary <br />nnazkers were up around the mine site. <br />Facilities <br />There were no coal haul trucks unloading and no rail cars being loaded during the inspection. No evidence of <br />offsite fugitive dust was observed. No problems were seen at any of the, other facilities. <br />Records <br />The records were in compliance, as noted on the attached records checklist. <br />c:/word/terror/insp0205 <br />
