<br />(Page 21 <br />MINE ID # OR PROSPECTING ID k M~3-028 <br />INSPECTION DATE 8130195 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This complete inspection was conducted by Wally Erickson from DMG, Durango field office. Mr. David King, Mountain Gravel, <br />accompanied the DMG inspector through out this inspection. Entrance to the site was located on the north side of County Road <br />556, approximately 1.3 miles east of Colorado Highway 184. Mine identification sign and affected area perimeter markers, required <br />by Rule 3.1.12, were not observed. Please ensure signs and markers are posted as per 3.1.12. <br />The access road was serviceable and did not exhibit evidence of recent use. Weeds were well established on the road. <br />Exhibits B, C, and E of the permit show the north and east boundaries of the permit area to be fenced. The mine site and the lands <br />bordering the permit area to the south and west showed evidence of heavy grazing activity from livestock. Additional fencing may <br />be necessary to control grazing and ensure successful establishment of reclamation vegetation. <br />Weeds were well established through out the affected area. Stands of Gambles Oak, approximately 20 inches tall, were also <br />established within the disturbed area. The operator needs to perform weed control measures on the affected areas of the operation. <br />Rule 3.1.1016) states that weed control shall be employed for all prohibited noxious weed species, and whenever invasion of a <br />reclaimed area by other weed species seriously threatens the continued development of the desired vegetation. Weed control <br />methods shall also be used whenever the inhabitation of the reclaimed area by weeds threatens further spread of serious weed pests <br />to nearby areas. A list of noxious and problem weeds and control techniques for these species can be obtained from the County <br />Extension Service, the County Weed Control District Office, or the local office of the Soil Conservation Service. <br />Mining related disturbance appeared to be contained within the permitted area. Vegetation and topsoil had been stripped. Topsoil <br />had been stockpiled; however, topsoil stockpiles were not protected with vegetative cover or by other means as required by Rule <br />3.1.9111. A low bench was cut along the east side of the proposed pit area. Material had been pushed to forma 10 foot high berm <br />approximately 100 foot long. Mining activity appears to have begun but has been discontinued. Annual reports, submitted by the <br />operator since 1983, state that mining operations have not commenced. DMG requests a written explanation, clarifying the <br />apparent discrepancy between the annual reports which claim that operations have not commenced, and observations recorded in <br />this inspection report, which indicate that the operation did commence but has not been active in recent years. <br />DMG records do not indicate that the operator has submitted a Notice of Temporary Cessation ITCI as required by Rule 1.13.5, for <br />operations in anon-producing status for 180 days or more. DMG records also do not indicate that the operator has submitted a <br />request fora 5 year extension to the TC period es provided for under Rule 1.13.8, for TC beyond the original 5 years. To resolve <br />this problem, the operator must execute one of the following options: <br />lal initiate final reclamation of the site; <br />Ibl submit a request for an extension to the initial 5 year TC period (this will trigger a mandatory Board <br />Hearing as only the Board can decide whether or not to grant such an extension); <br />Icl submit a request for a Technical Revision to the permit to allow intermittent mining activities as provided <br />for under Rule 1.13.7 (depending on the nature of the proposed intermittent mining, you may still be <br />required to submit a request for an extension of TC1: <br />Idl re-activate the operation. <br />Changes to the Mined Land Reclamation Act since the time that this permit was issued have included the removal of the S 5000.00 <br />bond cap for 11012) type permits. All mine sites in Colorado ars now required to be bonded for the actual cost of reclamation it, <br />in the case of permit revocation end bond forfeiture, the state ware to put the reclamation work out for competitive bid.
