III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations.made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a partial inspection conducted by Joe Dudash of the DMG. No one represented the operator <br />during the inspection. There was no snow cover and no activity at any of the visited mine sites. <br />Unit Train Loadout <br />The sediment control system was functional. Collection ditches leading to the sediment pond were <br />functional. The diversion ditches and berms had sufficient capacity. The sediment pond was dry. The <br />gated primary valve was closed and the emergency spillway was functional. There were no problems <br />with fugitive dust on the state highway. The three entrance gates were open and displayed the mine ID <br />signs, which are fading and need repair. In addition, the name of the pennittee and operator have <br />changed to Bowie Resources LLC as a result of the issuance of Succession of Operator No. 4. <br />Therefore, all of the mine ID signs at Bowie No. 1 need to be changed accordingly. <br />Hialrway Coal Stockpile <br />The coal at this site has been removed and the site was covered with subsoil as interim reclamation. <br />There were no signs of slope instability or erosional gullying at the site. The sediment pond a little <br />water in it. The straw bales along the south side of the railroad tracks were in place. The straw bales <br />around the culvert inlet at the west end of the site were in place as well, although one more bale would <br />make the sediment control more effective. <br />Run-of--Mine (ROM) Stockpile <br />There was only a very small volume of ponded water on top of the ROM pile. The sediment control <br />system was functioning. There was only a small amount of standing water in the sediment pond. The <br />pond spillways were functional with the gated primary tube gate in the closed position. The graveled <br />haul road was in very good condition. <br />West Mine <br />The vegetative cover on the backfilled and graded portal bench was moderate to good. There were no <br />indications of slope instability or erosional gullying on site. The two sediment ponds were dry. At the <br />West Mine fan site, the silt fence needs some repair. Also, hunters left animal remains and some <br />garbage near the reclaimed vent shaft. <br />c:/word bowie 1/inspl 104 <br />
