~--~ <br />subsequent date. 100-year diversion ditches are in place and <br />sound. We discussed the necessity of tying reclamation of the <br />bench above into the diversion ditch system. Desty Dyer <br />reported no concerns about the refuse pile, which is mostly if <br />not entirely on BLM surface. <br />The remainder of the East mine consists of a series of benches <br />cut into the slope, like stairs, above the refuse pile. The <br />overburden from these cuts, according to Joe Dudash, forms the <br />base of the coal stockpile at the bottom of the slope. Each of <br />the benches had had various structures which are being <br />demolished. None of the benches have been completely cleared, <br />and no backfilling or grading have started. Several areas were <br />being used for materials storage. <br />Joe Dudash went in detail through the line-items in the bond <br />calculation for structure demolition, noting which line items <br />had been completed. Since I do not believe this area qualifies <br />for bond release, I did not take my own notes. <br />Mr. Pavlisick was concerned that the backfilling and grading not <br />totally eliminate the road to the upper bench, noting that he <br />wants access to the top of the slope. He also noted that there <br />is some sort of power-line right-of-way up the slope. <br />Due to lack of time, the inspection did not include the load-out <br />area in the valley bottom. <br />y ~ ~~ <br />
