III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown by Harry Ranney of CDMG on May 30, 2002. Digital images were recorded at <br />the time of the flight. The digital images were reviewed by Jane[ Binns of Colorado Division of Minerals and <br />Geology on 6/I 1/02. Review of these images is the basis for this inspection report. <br />The mine is an active surface mine with 5 active pits and an ash disposal pit.. <br />Hvdrol~ic Balance: East Flume, East Middle Flume, Middle Flume 1 & 2 ponds all contain water that appear [o be <br />below the spillway elevations. West Flume pond water elevation looks to be close to the spillway elevation. It is not <br />clear from the aerial photo if this pond is discharging. Oak ponds are holding water. East Pyeatt ponds 1 & 2 are <br />holding water. No problems were apparent in the West Pyeatt drainage. Johnson Ponds, IOR, 9R, 8R, 7R, and 6 all <br />were holding water. Stockponds throughout Johnson drainage contain water. Ute 1 Pond is holding water. No <br />Name No. 2 Pond is holding water. No problems were apparent in [he No Name drainage. <br />General Mine Plan: Active mining continues in Pit A. The operator continues to backfill as [he pit progresses. <br />Regrading is not following the rough backfill of A pit in anticipation of re-mining deeper seams in this area. The <br />"Z"pit remains active. Draglines are observed in A pit, Z pit and F pit. No problems were noted in the Ash Pit. <br />Mining continues in the D/B pit but with out the use of a dragline in this combined pit. <br />Backfill & Gradin>?: TMI regrading the west side of Pit F is keeping up with mining. Only one spoil ridge was <br />apparent between the regraded slope and Pit F. Regrading on the west side has occurred contemporaneously with <br />the progress of the D/E pit. <br />Reclamation Success: The Mine site has been very dry with the entire state experiencing a drought. Vegetation is <br />patchy and noticeably brown considering the time of year. The gully on the 2001 Pit F reclaim area and shrub <br />research plots has been repaired.
