III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on October 19, 2004 by Mike <br />Boulay of the DMG. Robert Shevling and Dennis Jones of Seneca Coal Company were present <br />for the inspection in the morning and afternoon, respectively. It was raining lightly and ground <br />conditions were wet and muddy throughout the mine site. There was also some light snow cover. <br />A dozer was working on rough backfilling and grading in the northern end of the South V alora <br />Pit and the dragline was operating in the Scraper Pit at the time of the inspection. <br />Availability of Records <br />With the exception of a current Insurance Certificate, all required records were on file and <br />available for review at the mine site office. The Certificate of Insurance expired on 10/Ol /04. <br />Please update the record files with a current Certificate of Insurance and forwazd a copy to the <br />Division for our records as soon as possible. <br />Roads <br />Haul Roads A and B were very muddy and wet, but were accessible. Water was not flowing in <br />road ditches and road drainage runouts along these sections of haul road. Culverts along Haul <br />Roads A and B were cleaz of sediment and debris and functioning properly. Haul Road D, the <br />active pit area, and the North pit were not accessible due to muddy and slick road conditions. <br />Hvdrologic Balance <br />Sedimentation Ponds 010, 011, 012, 013, and 014 were inspected. Ponds 010, 011, 013, and 014 <br />were retaining water but not discharging. Ponds 010 and 013 were nearly full. Water levels in <br />Ponds 011 and 014 were well below the level of the principal spillways. Pond 012 was full and <br />dischazging a very small amount of clear water. Pond O11A was not accessible. Pond inlets, <br />embankments, and dischazge structures appear stable and no problems were noted at any of the <br />inspected pond locations. <br />The lower Armand Draw drainage was inspected. This is the location of NOV-2004-002. The <br />drainage was stabilized, the erosion repaired and 6 rock check dams were installed prior to this <br />inspection. SCC successfully completed the abatement measures for the violation and the <br />violation was terminated on September 28, 2004. SCC personnel indicated that SCC inspected <br />the entire length of the drainage during the week of October 3, and the drainage was stable at that <br />time. <br />
