III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Convnents also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On July 26, 1991 the Division conducted a complete inspection at <br />the Terror Creek loadout. Present during the records check was <br />Evelyn. The weather was partly cloudy at the time of the <br />inspection. It had rained a bit in the past several weeks due to <br />the typical late summer monsoon. <br />The inspection included a records check and all were found to be <br />in order. <br />The coal handling area was toured and sediment control was <br />checked. The sediment traps east of were the haul road enters the <br />coal handling area had trapped a good amount of sediment; these <br />were working efficiently to slow sedimentation of the pond. The <br />ditch in this area contained some water from recent rainfall. <br />The sediment pond on the far eastern portion of the pad area was <br />observed to be in good condition. Inlets and outlets were free <br />from erosion and the embankments were stable. There was a small <br />puddle of water and there was very little sediment in the bottom. <br />The berm along the southeast side of the coal pad was walked and <br />this was stable and well vegetated. The 5000 gallon drum storage <br />are was fully bermed. There appeared to be some spillage for <br />diesel fuel within this area. <br />The sediment control along the railroad tracks appeared to be <br />working effectively. Filter fences were functioning and the area <br />had some vegetation growing in the drainage way which acted like <br />a sediment trap. Very little runoff appeared to have occurred <br />here. <br />The topsoil pile at the western portion of the area was marked <br />and well vegetated. The berm around the pile were working well. <br />And the sediment trap at the bottom was in good condition. The <br />ditches on the northwest side of the coal storage pad were clear <br />and functioning. <br />An operator was not at the coal processing area. According to <br />Evelyn the men were working on a derailed train car. <br />
