III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any enforcement <br />actions taken during the inspection and the facts or evidence supporting the <br />enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado <br />Division of Minerals and Geology. Rick Mills represented the operator. With <br />the operator's consent, this report was issued from the Denver office. <br />The ground was wet from recent rain. <br />The longwall was active in panel 14 Right. <br />Roads <br />Construction of the batch-weigh loadout haul road has been completed. No <br />problems were found at the site. The operator's representative explained <br />that an as-built certification will be forthcoming. <br />Fish and Wildlife <br />Richard Guptill, a mine electrician, went along on part of the inspection <br />to look at powerlines noted in last month's inspection as needing bird <br />perches re-installed. The perches on the H-pole powerline that parallels <br />RCR 179 south of the Fish Creek tipple were found not be of concern <br />because that line is not part of the mine. YVEA probably would be <br />responsible for maintenance. A survey is planned for all older power <br />poles in the permit area. <br />The operator's representative discussed plans to submit a revision <br />application to remove from permit page 2.05-16 the requirement to post a <br />speed limit sign on the road to the Fish Creek borehole. Such a sign is <br />not necessary as indicated by a lack of vehicle/big game collisions along <br />the road. <br />SUBSIDENCE <br />As viewed from a distance, no adverse subsidence impacts were evident <br />from recent mining on the east end of panel 14. Muddy conditions <br />prevented a closer look. No structures or renewable resource lands were <br />undermined in this area. Fish Creek in the area over panel 13 now is <br />nearly bankfull, but is not flooding. This stretch of the creek was <br />nearly dry this summer. <br />3 <br />
