On the inspection <br />day, my notes clearly indicate only one issue requiring attention: the static ground <br />water level reduction. I recall specifically discussing "problems" and being reassured <br />that our operation looked "clean." <br />I respectfully disagree with the inspection report and will address each "Possible <br />Problem" individually and in detail. <br />1. The current static ground water level reduction system is not a "dewatering <br />system." Dewatering implies the ability to implement dry mining techniques. <br />The presence of the operating dragline proves wet mining techniques are <br />being utilized. A switch sensitive to the static ground water level engages the <br />floating pump. The pump currently operates approximately 80% of the day. <br />The fact that the pump does not operate continuously proves our intent to <br />reduce the ground water level to a manageable level only. It is our hope to <br />eliminate the pumping as our mining proceeds. I will concede this item for <br />technical revision with the agreement that the term "dewatering" is not <br />required in the document. <br />The Phase IV processing area is specifically labeled asphalt plant. In a June <br />2, 1999 correspondence from The Division, the asphalt plant was eliminated <br />from the permit. Aggregate processing, as stated in the permit application, <br />will be located "adjacent to the active mining pond." Due to the high ground <br />water level, any staging area located near the river will require building up. <br />This is temporary and will be relocated as mining progresses according to the <br />application. This issue does not constitute a revision in the permit. <br />3. Please refer to the attached letter from Otero County Board of Commissioners <br />regarding road improvements along the north boundary. In addition to the <br />improvements being at the request of the county, the property is not included <br />in the permit per a correspondence from The Division on June 2, 1999. <br />-~ <br />
