III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete quarterly inspection of the mine site and office records. Site <br />inspection was conducted 6/24 and 6/25. Records were checked on the afternoon of 6/28. <br />7onya Hammond of SCC was present during portions of the inspection on 6/25 and 6/28. <br />Weather was clear and warm and site conditions were dry. There has been very little <br />precipitation during the month of June. <br />Availability of Records <br />Required records were on file and up-to-date through .the 1" quarter, 2004. <br />Signs & Markers <br />There is an outdated MSHA I.D. number on the UTL Gate I.D. sign, that should be updated <br />or removed (painted over). <br />Roads <br />~ Permit area roads and associated drainage structures appeared to be properly maintained <br />and functional. <br />The Union Pacific access road adjacent to the railroad tracks between the former <br />Conveyor Transfer 112 Site and the Xcel access road that had been eliminated in <br />association with the conveyor corridor reclamation project has now been properly <br />restored. Topsoil removed from the road footprint was spread on a portion of the salt <br />affected "bare area" within the North Portal Reclamation parcel, and reseeded in late <br />April/early May. <br />Hydrologic Balance <br />All sediment ponds and SAE sumps were dry, with adequate storage capacity. Ponds <br />and sumps inspected were Pond 1 &2, Pond 6, Pond 7, Pond 8, Pond 9, Pond 10, Pond <br />11, Pond 13, Sump CBA-1, and the two SAE sumps at the North Decline Area. <br />SAE silt fence and berm features were in most areas properly maintained and <br />functional. Silt fence maintenance is warranted in a couple locations where fencing has <br />come loose from the stake or one or more stakes were knocked down by cattle. Silt <br />fences at the South Fan site (upper silt fence) and the "B" Substation (lower silt fence) <br />need to be repaired. <br />0 Drainage collection, diversion, and conveyance structures were properly maintained and <br />functional. Maintenance is recommended at two locations this field season. There is <br />minor scour at the base of the riprap ditch segment which extends from the former <br />
