III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion. of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the inspection. Most of the various mine site locations were clear of snow cover. There <br />was no activity at any of the sites. <br />West Mine <br />The only snow cover on the backfilled and graded portal bench area was along the edges of the <br />distwbed area and behind the embankments of the two sediment ponds. The site has done well so far <br />this winter. There are no signs of slumping or erosional gullying. The vegetative cover is fairly good. <br />There was a small amount of standing water in the upper sediment pond and a larger amount in the <br />lower pond, at about the level of the primary discharge pipe: The road up from Stevens Gulch to this <br />site was in good condition. <br />Run-of--Mine (ROMI Stockpile <br />Only a small amount of coal waste is still at this site. There was no snow at this site, although there <br />was a small volume of pooled water on top of the stockpile. The collection ditches were well vegetated <br />and had sufficient capacity. There was only a small volume of water in the sediment pond. The gated <br />valve of the primary discharge pipe was in the closed position. The graveled haul road was in good <br />condition. Surface distwbance markers were present. <br />Unit Train Loadout <br />All three entrances to the loadout were open. There were no signs of coal or dirt tracked onto the main <br />highway. The collection and diversion ditches at the loadout were functional. The sediment pond was <br />dry with the primary and emergency spillways functional. The diversion ditch and culverts above the <br />pond were functional. <br />East Mine <br />The mine site gate was locked. The paved haul road was in good condition. The operator has been <br />maintaining the ite. Rocks have been removed from the roads and ditches are being cleaned. The dirt <br />road up to the portal bench was graded recently. No problems were noted at any of the mine benches. <br />There were no stability problems with any of the cut and fill slopes. <br />There were no slope stability or erosional problems at the West Ridge waste pile. The collection <br />ditches on the benches and the upper diversion ditch were functional. The vegetative cover was good. <br />There was no standing water in the sediment pond. <br />c:/word bowie 1 /insp0305b <br />
