Long <br />Dinsion Durci~ <br />Permit M-91- <br />i <br />In tY.le reports I prepared of inspections made of the above <br />re:Eerenced pits on October 5, 1994, I identified the absence of <br />storm water management plans for both pits as compliance problems. <br />I :Euri:her required that Kiowa County supply evidence by 12/4/94 of <br />such plans or that they were not required for Stormwater Permits by <br />thla Water Quality Control Division. This letter is to notify you <br />that i:he absence of storm water management plans for Kiowa County <br />aggregate pits is not a comgliance problem and that the county is <br />to ignore the requirements made in my inspection reports that <br />ev:iderrce of such be supplied by the specified date. <br />Check of materials supplied by the WQCD in regard to Storm Water <br />Pe3_-mit:s finds that counties with less than 100,000 population are, <br />for tY.le moment, exempt from state requirements to have storm water <br />permits for their gravel mining operations. I believe Kiowa County <br />qu<rlif'ies as having less than 100,000 population and is therefore <br />exempt:. <br />I apologize for any inconvenience that my reports may have caused <br />in this regard.
