ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: >~-~lN17-~~ <br />INSPECTION DATE: 4(lfl/fI7 INSPECTORES INITIALS: ~- <br />OBSERVATIONS <br />1)The Division conducted a pre-operational inspection of the site on 4/13/07. Present <br />during the inspection was Mr. Tim Scanlon the operator's consultant. <br />2)Site is being proposed to be a phased 112 sand and gravel operation consisting of seven <br />phases for a total permit area of 250 acres <br />3)Site is located approximately 6 miles North West of Walsenburg Colorado. <br />4)Permit application sign was properly posted at the access to the property. <br />5)Within the proposed permit area, in addition to pre-law disturbed acres, with an old <br />scale house. There are also two ACTIVE 111 permits. M-1997-042 & M-1998-081 <br />6)Since the 111 permit holder has still a lot of material stockpiled in place, which the <br />112 applicant is interested in utilizing, the Division asked the 112 applicant if <br />there was a way they could include both 111 permits in the new 112 application. <br />Normally, 111 permits can not be amended, however, in this case, if they are included <br />in a new 112 permit, and both parties are agreeable, the Division, will allow such <br />inclusions. <br />7)While on site, contacted the 111 permit holder's consultant Mr. Joe Gagliano, and the <br />consultants agreed to include the 111 permits in the 112 application. The 112 <br />applicant agreed to re-publish with the added cares from the 111 permits. The legal <br />description for the 112 permit will not change, because the permit acres of the 111 <br />permit are with in the legal description of the 112 permit. <br />8)The applicant has included in the application, an agreement for all man made structures <br />with in 200 feet of the affected area. <br />9)The site is as described in the permit application. All of the permit area is fenced. <br />After the completion of the inspection the land owner's son, Anthony Franciscotti, met <br />us at the access to the property and we explained to him what we were doing and showed <br />him the map utilizing the mining plan map, what was being- proposed. At that time the <br />Division asked him if he could move some of the old mining equipment scattered in the <br />area and move it to a recycling yard or in a designated area of the permit.
