III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of Mountain <br />Coal Company represented the operator. The ground was dry. Selected photos taken during the <br />inspection aze attached to the end of this report. With the operator's consent, this report was issued <br />from the Denver office of DRMS. <br />Sims and Markers <br />Mine i.d. signs were properly displayed at the two entrances on Highway 133 and at the corrals <br />staging/laydown area. Topsoil markers were properly displayed on topsoil stockpiles seen during the <br />inspection, with the exception of Shaft Construction Laydown Area in Sylvester Gulch where the <br />stockpile is being regraded. The operator explained that the mazkers will be re-intalled when grading <br />is completed. Stream buffer markers were in place in Sylvester Gulch. The affected azea boundary was <br />properly marked by signs around the perimeter of the disturbed area in the main surface facilities azea. <br />Roads <br />Road surfaces, embankments, and road ditches and culverts were in good repair in the main surface <br />facilities area Sylvester Gulch. Construction work continues on the Sylvester Gulch Road extension <br />(approved in TR-99). <br />Hydrolo¢ic Balance <br />The mine was discharging an estimated 1 cfs of clear mine water from outfall 017 in Sylvester Gulch. <br />Unlined ditches next to Sylvester Gulch Road and aoound shaft sites in the Gulch were in good repair. <br />A long-reach excavator was removing sediment from pond MB-2R. <br />The Lower Dry Fork alluvial well appeared in good shape. The Middle Dry Fork flume was in good <br />repair. <br />Backfilline and Gradin¢ <br />The road from Shaft 3 that leads to methane drainage we1124HG2XCE3XC (and others) has been <br />regraded, seeded, and mulched since the previous inspection (see photo below). <br />3 <br />
