(Page 2) • <br />MINE ID ¢ OR PROSPECTING ID ¢ N-94-103 <br />INSPECTION DATE 04/16/96 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This partial inspection was performed by the Division to follow up an enforcement action <br />(from NOV No. M-95-057), and to provide an opportunity to meet with the operator oneite and <br />discuss the problems delaying the completion of the 110 application. The operator was <br />contacted about the inspection and was present for it. <br />There has been no illegal mining activity since the operator was observed oneite during the <br />7/6/95 inspection. <br />The operator attempted to locate the corners of the proposed permit area, but the markers <br />were not found. The approximate locations were indicated, and seemed to exclude significant <br />portions of the operator's admitted current disturbance. The operator stated that about one <br />acre of disturbance on the extreme east end and about two acres on the went end were not to <br />be included in the permit area. This was supposedly due to the fact that the owners of those <br />portions of the site did not want further mining to occur. It was pointed ovt to the <br />operator that this was contrary to the requirements of the Board Order, and that the gravel <br />in the small area the operator did want to permit was already mostly mined out. At this <br />point the operator felt that they should simply reclaim this site. The operator was reminded <br />that the entire five-acre site must eventually be reclaimed (with or without mining preceding <br />it) and that the Board moat approve any actions differing from the Board Order, before work <br />commences. This should be discussed at the Board meeting next week. <br />This inspector recommended that the operator begin preparing for the Board hearing and for <br />the actual reclamation by contacting the Natural Resource Conservation Service immediately, <br />and to determine what schedule of its implementation would be feasible to commit to.
