(Page 2) <br />MINE ID # OR PROSPECTING ID # M-77-546 <br />INSPECTION DATE 11-3-99 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a partial inspection of the Horvath Pit No. 1, conducted at the operator's request, to discuss recommendations <br />and requirements relating to a proposed expansion of the existing operation. <br />Mr. Brice Lee, permitee and operator for this site, indicated that proposed expansion would extend the existing pit to the <br />southeast. The expansion would not exceed the 9.99 acre limit for 110c operations and would keep the pit boundaries <br />within Mr. Lee's property boundary. The south end of the proposed expansion would become a corral area with a gravel <br />base, no topsoil or revegetation required. The remaining pit is proposed to be reclaimed as is approved for the existing pit. <br />Mr. Lee indicated that the operation would be phased, with approximately 2-3 acres of excavation open at a time. The <br />pit slopes would be final graded, behind the advancing highwall, as the excavation progressed. The proposed corrall area <br />would be the stockpile and processing area. The only permanent manmade structures observed in the proposed expansion <br />area or within 200 feet of that area are a couple of Mr. Lee's barbed wire fences and a corral. <br />Vegetation on the site consists of dryland pasture grasses. Topography is shallow rolling hills. <br />The problem noted in the last inspection report, slumping of the backfilled and topsoiled northern pit slope, was not repaired <br />by May 31, 1999 as required in the last inspection report. The proposed expansion would affect this area and may justify <br />having not repaired that slump. However, the operator is required to notify the Division when a corrective action due date <br />will not be met, and indicate the reason for the delay in correcting the problem. If the pit is to be expanded and activated, <br />Mr. Lee will need to be more diligent in ensuring the site is in compliance, and in meeting requirements and deadlines set <br />by the Division.
