ORIGINAL-PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~-~9~t-nn~~T <br />INSPECTION DATE: Z/I> ins INSPECTOROS INITIALS: ~~ <br />OBSERVATION <br />The Division conducted a follow up inspection of the site on 7/11/06.When <br />the site was last inspected on 5/9/06; the Division had requested the <br />operator to submit an acreage reduction request to remove a portion of the <br />permit area associated with the process plant. Post mining land use for the <br />area is heavy Industrial, the process plant and associated structures will <br />be left in place even after mining is completed on site. Since the Division <br />never calculated the warranty for the removal of these structures when the <br />permit was issued and subsequent revisions, it was suggested to the <br />operator to either bond for them or remove them from the permit area, Since <br />the process plant accepts aggregates from other sources it is in essence a <br />custom processing plant. Since the post mining land use for site is for <br />heavy industrial, it meets the requirements of the Construction Material <br />Rules and Regs for release. <br />On 6/1/06 the release request was submitted. However, the submittal even <br />though it included maps showing the areas to be released, it did not <br />include the new permit area delineation. The Division had requested one <br />mining plan map and one reclamation plan map showing the new areas. Since <br />the submittal of the release request, the operator's environmental person <br />who submitted the maps had accepted another position. Mark Refiner who has <br />been assisting them as a consultant is now going to submit the maps as <br />requested and we met on site so he can see the areas to be released. Drove <br />and inspected the areas to be covered under the requested release. A few <br />GPS points were collected and both Mark and Jerry agreed top submit a 60 <br />day decision waiver so the new maps can be submitted. Once the written <br />decision waiver is submitted the Division will change the date and approve <br />the release after the maps are submitted.
