III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Include discussion.of observations.made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the DMG. No one represented the operator., <br />Unit Train Loadout <br />There was no activity at the loadout. No railcars were on site and no coal haul trucks were unloading. The <br />entrance roads were well maintained. There was no coal dust tracked onto the highway. One of the three gates <br />was closed. The mine ID sign was up. There were no problems observed at the fuel faciiiry. <br />The sediment control system was fancfional. Collection ditches had enough capacity. The diversion ditch and <br />culvert system in the middle of the loadout azea was also functional. There was no water in the sediment pond. <br />The bin wait of the pond was intact. The upland diversion ditch and culverts were functional. , <br />Run Of Mine (ROM) Pile <br />The sediment control system at the ROM pile azea was functional. Ditches had enough capacity and culverts <br />were cleaz. There was a small amount of water in the sediment pond. The pond embankment was well vegetated. <br />The graveled haul road was in very good condition. There was no ponding of water on top of the ROM pile. At <br />the topsoil stockpile, the topsoil sign needs to be put back up on its post. - <br />West Mine <br />At the West Mine fan site, the operator has sprayed the thistle. The siit fence could use a little maintenance. The <br />topsoil stockpile was well vegetated and the topsoil stockpile sign was up. The mine ID sign was up at the <br />entrance. The entrance road was in good condition. <br />At the West Mine, the area west of East Roatcap Creek has good vegetative growth, although some azeas are <br />lagging behind in vegetative cover. On the east side of East Roatcap Creek, the vegetative cover was spazse. <br />Although there was some rilling on the reclaimed azeas, no gullying was observed. The operator has sprayed for <br />thistle, although new growth is coming up. <br />The upper sediment pond was dry, while there was a little water in the lower pond. The gated primary of the <br />upper pond was open and that of the lower pond was closed, as designed. Emergency spillways were functional <br />and the riprap of the spillway downdrains was in place. The operator has installed new straw bales in the road <br />ditch on the north side of the West Mine reclaimed area. <br />Well Field • <br />The mine ID sign was up at this site. The topsoil stockpile had a good vegetative cover. However, some thistle is <br />starting to grow and should be sprayed. The two topsoil stockpile signs were off of their posts. <br />East Mine <br />The gated valve of the last bin wall pond in series, Pond 4, was closed. The pond was dry. Pond inslopes were <br />stable and no problems were observed with the bin wall, The next pond up, Pond 3, also was dry. It's gated <br />valve was open.
