III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Jim Stover and Bill
Bear represented the operator during a portion of the field inspection.
Roads
The paved entrance road was in good condition and free of debris from the adjoining property. The
cable across the road at the top of the hill was down. The bridge was passable. The entrance gate was
locked and the "no trespassing" sign was on the gate.
Hvdroloav
The east spring was flowing the usual orange-colored water. The temperature of the spring water was
measured at 98 degrees Fahrenheit at a point about I S feet down from where the spring came out of the
hillside. There was no evidence of the west spring.
The sediment pond had a little water in it. The gated valve on the primary discharge pipe was closed.
Pond inslopes were well vegetated and stable. The water level in the spring water treatment pond was
about 6 inches below the horizontal pipe. The pond was discharging at about 20 to 30 gpm and was the
usual orange color. This water has been found to be incompliance with water quality standards.
Reclamation
The backfilling of the reclaimed road up to the portal bench is holding up well. There is a depressed
area, about two feet deep and about 5 ft by 15 ft, behind the backfilled east portal that maybe a
subsidence feature. The west portal backfilling has been showing signs of cracking and settling and
must be dean with. On the cliff above the backfilled west portal, a vent has increased in size and
appears to be linked to the mine below it. The slide just west of the disturbed area continues to come
down slowly.
ReveQetation
The vegetative cover on the hillside is good. The operator sprayed for thistle on the reclaimed road.
The operator also pulled out the tamarisk that had been growing along the edges of the spring water
treatment pond. However, additional tamarisk is growing in the area of the east spring and near the
entrance gate.
Facilities
The mine office is in a state of disrepair but no new problems were observed. The doors were open.
c: /word/bear3/insp0805
