IV. ENFORCEMENT ACTIONS
The following identifies enforcement actions taken during this inspection, the required
abatement and date of abatement for the violation, previous violations still requiring
abatement and the termination of violations cited during previous inspections.
North Thompson Creek C-81-025
15 Sept 2004
NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS
Notice of Violation CV-2004-004 was issued as a result of this inspection. The violation was
issued for failure to maintain ditches to minimize adverse impacts to the hydrologic balance in
violation of Rules 4.05.3(1) and 4.05.3 (4J and for failure to properly control the discharge from
a treatment facility in violation of Rule 4.05.7.
First, the ditch from the discharge from the portals to the Long Pond was partially blocked,
causing water to leave the ditch and flow down the light-use road. Water had, at the time,
flowed approximately 150 yards down the road. Second, the primary discharge from
treatment pond T-2 is partially blocked, causing flow from the emergency spillway pipe. This
pipe has been cut-off, causing the discharge to flow overland into pond P-9. Approximately
YZ-acre is covered with water.
The abatement for this violation is first, to clean the ditch from the portal discharge to the Long
Pond and perform any other maintenance as necessary. Second, the Operator needs to
clean the primary discharge pipe on treatment pond T-2 and install an anti-clogging device.
The emergency discharge pipe needs to be fixed so none of the discharge flows overland.
These abatements must be completed by 21 October 2004.
