III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This mine is preparing to begin road and pond construction <br />activities as approved under Technical Revision No. 6 (TR-06). As of this <br />inspection, construction activities had not begun. Permit Revision No. 1 (PR-O1) <br />is now in the thirty (30) day public comment period. The public comment period <br />expires on October 19. 2001. <br />Roads <br />The existing road up to the Jeff Canyon surface mine area was inspected. This <br />road provides access to a number of coal bed methane sites in this area. Widening <br />activities along this road have not yet begun. <br />Hydrologic Balance <br />Future pond locations for ponds 007, 009, and 009a were located. Each location <br />was staked with a wooden lathe labeling the embankment corner. The northeast <br />corner of Fill 7 was also staked. Each location was photographed. Light-use roads <br />to the pond sites have yet to be constructed. <br />Support Facilities <br />The support facilities for the mine are portable. The operator has established an <br />office trailer and two rail cars for storage at the mouth of Jeff Canyon on an <br />area used by the gas company for material storage. <br />The mine is in compliance with the approved permit. <br />3 <br />
