Page 3 • • <br />• October 11, 1991 <br />Inspection report <br />File no.: M-73-007 <br />We are not sure exactly how much material is on the ground, but <br />this entire site will be flown and mapped in the next couple of weeks. <br />Once the map is prepared we should be able to calculate a very accurate <br />figure for you. <br />Page 1-2: You state that the 1991 annual report indicated 25 acres were <br />backfilled, 10 acres graded, and 3 acres seeded. <br />RESPONSE: Referring to previous annual reports it appears the <br />stated value for backfilled land has been essentially the same since at <br />least 1988. Backfilled land primarily includes old settling ponds <br />located on the west side of Academy, as shown in the annual report maps. <br />Some of this land is currently being used for access between this <br />operation and the Castle Concrete pit to the north. Backfilling with <br />settling ponds is the first step in the reclamation of some of the land <br />on this site. After that land is no longer needed it is final graded, <br />[opsoiled (if applicable), and placed under revegetation. Whether the <br />land is further utilized after backfilling or not does not detract from <br />the fact it has been backfilled. Therefore, if one understands the <br />nature of the permitted plan, there is no way to misunderstand what the <br />term backfilled means with respect to this operation. <br />The 10 acres of graded land is primarily backfilled land that is <br />being prepared for revegetation. The 3 acres of seeded land near the <br />entrance to the operation did not actually need to be seeded, but as <br />your file should reflect, in accordance with a recommendation from <br />Camille Farrell, it was seeded. I personally seeded it. <br />Page 1-2: You state that the operator (Mr. Herskind) informed you that <br />no reclamation had taken place. <br />RESPONSE: Mr. Herskind informed me that he told you the 3 acres <br />near the entrance had been reclaimed. He may have also shown you the <br />approximately 5 acres of land in the northwest corner of the portion <br />west of Academy that has been graded and will be topsoiled and seeded <br />this coming winter. <br />Page 2-2: You state that discharge from the plant was being deposited <br />into the adjacent Castle Concrete settling pond which is also owned by <br />Transit Mix Concrete. <br />RESPONSE: Firs[, the settling pond is not Castle Concrete's. We <br />suspect you really didn't mean that and it is simply a grammatical <br />error. The settling pond is in Castle Concrete's Sand Pit. But the <br />main comment we have is that the Castle Concrete Sand Pit is owned by <br />
