III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action, <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (Division). This former mountaintop removal operation is now reclaimed and <br />has achieved a Phase I bond release for most areas, Ground conditions on this day were <br />very dry and the weather was unseasonably warm. The region in general is in dire need of <br />winter snow cover. <br />Roads <br />The second culvert ascending the Jeff <br />Canyon haul road remains partially <br />blocked with sediment due to summer <br />storm runoff- This culvert should be <br />cleared as soon as equipment is <br />returned to the site. <br />Hydrologic Balance <br />Pond 9, shown at right, located on the <br />north side of the disturbed area. held <br />water at about 1/3 capacity Pond 9a <br />located in Jeff Canyon below Fill 9 was <br />observed dry. Pond 10 at the coal <br />loadout held a small amount of water. <br />The downstream Purgatoire River <br />alluvial well is located adjacent to pond <br />10 and was found capped. <br />The SAE sediment treatment <br />measures for the large topsoil pile <br />footprint on the east side of the pit area <br />should be repaired and maintained in <br />accordance with the approved permit. <br />Silt fence and straw bales have been <br />compromised by wind and animals. <br />Pum m of water from a ravel it F- =='.,`'`' ~e~ ` <br />operated by the landowner has ..YY; f t-^P'.~;.~ ~-•_ ;, <br />breached the loadout topsoil pile ~` • '-z ~ ~' •' <br />containment ditch on the south side adjacent to Lorencito Canyon. Ple <br />operator repair this ditch so topsoil pile runoff is properly directed to po <br />Overall, the site appeared in good condition for the late winter season. <br /> <br />
