<br />MINE ID # OR PROSPECTING ID # <br />INSPECTION DATE 9 18 96 <br />(Page 2) • <br />None <br />INSPECTOR'S INITIALS AJW <br />This was a citizens complaint inspection conducted by Tony Waldron of CDMG and accompanied <br />by Cheater Barnard and Leo Purdue, who are the prospective operators of the site. The <br />inspection was conducted as a result of an anonymous complaint filed on August 19, 1996. <br />Coincidentally, Mr. Barnard visited the offices of DMG on the very same day to inquire about <br />obtaining a reclamation permit for the site. At that time the Division staff informed Mr. <br />Barnard that an inspection of the site would be conducted to determine whether the activities <br />occurring on site would be considered mining. If, after the inspection, it was determined <br />that mining activities were occurring on the site, Mr. Barnard would be contacted to discuss <br />this matter before the Mined Land Reclamation Board. <br />The initial attempt to inspect the Bite was made on September 9, 1996, but the inspector and <br />Mr. Barnard missed connections and the site was not located. On September 18, 1996, Mr. <br />Barnard and the DMG inspector were able to meet and proceed up to the site where we met Leo <br />Purdue. The site is located on a ridge top known ae Beech Hill and just south of another <br />permitted quarry site (M-92-108). The area has been historically quarried as has much of the <br />surrounding area. Mr. Barnard'e property ie approximately 30 acres with about 15 acres on <br />the east aide of the ridge and approximately 15 acres falling away off the back and west aide <br />of the ridge top. The east 15 acre site is moderately eloping to the east and is where <br />quarrying has occurred in the past and is proposed for the future operation. The back aide <br />of the ridge is very steep (nearly vertical) to a point where it meets a long moderate elope <br />that ie currently used for cattle grazing. The property boundary extends a few hundred feet <br />to the west from the cliff/elope interface and will not initially be used in the mining <br />operation. <br />Upon arriving at the site, the property was walked starting at the NE corner property marker. <br />Mr. Purdue has been living at the site and has been conducting some preparatory activities <br />such ae leveling out old rubble piles to create some level working areas. There ie a fairly <br />large quarry located along the north aide of the property which has a small pond in its <br />bottom. A little further to the south there is a larger historic quarry that begins near the <br />ridge top and extends downslope for approximately 100-150 feet and is approximately 100 feet <br />wide. At the toe of this quarry, fresh quarrying activity has occurred recently with a new <br />cut that begins at the toe and advances to the south for approximately 100 feet. Layers of <br />sandstone had recently been cleaved out of this area. Some of this material has been placed <br />on pallets that were adjacent to the fresh workings. There was a small bulldozer sitting <br />just north of the fresh cut along with a small crane and track excavator sitting on the small <br />highwall on the east aide of the fresh quarry. Further to the south, additional rubble pile <br />leveling along with minor quarrying was evident. No equipment or palleted material was <br />present at this location. <br />Just east of the first quarry, an access road had been constructed which provided access to <br />both quarries. This road was approximately 200 feet long and was constructed using a cut and <br />fill method. It was mentioned that some of the quarried material had been hauled off site. <br />All of the new disturbances appeared to be contained within Mr. Barnard'e property <br />boundaries. <br />Since there ie evidence to suggest that quarrying activities have occurred at this site <br />recently, the Division ie issuing a Cease and Desist Order to atop any additional mining <br />act iv itiee until a reclamation permit ie obtained. In addition, a Reason to Believe Letter <br />ie being sent to Mr. Barnard and Mr. Purdue, requesting that they appear before the Mined <br />Land Reclamation Board to determine if they are conducting mining operations without a permit <br />which ie a violation of C.R.S. 34-32.5-109(1).
