III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of Colorado DMG. No one <br />represented the operator. This inspection involved observations made at the Bowie No. 1 <br />loadout, the highway section between the Bowie No. 1 loadout and the Bowie No. 2 Mine <br />and at the Bowie No. 1 highway coal stockpile. The observations were made from outside <br />the permitted area. <br />Fueitive Dust <br />At the loadout, the coal stockpile near the truck dump remains. According to Bowie No. <br />personnel, there is difficulty getting coal railcars again so Bowie Resources has not been <br />able to ship out the coal stockpile at the truck dump. <br />There is a small amount of coal dust on Highway 133 at the loadout exit gate. The coal <br />dust is a very small amount and has been tracked onto the highway for about 50 feet. It <br />does not appear to be a problem at this time but could develop into a problem if allowed <br />to increase in size. <br />Several Bowie No. 2 coal haul trucks were observed going to and coming from the <br />loadout, and all of them appeared to be going the speed limit. There did not appear to be <br />any fugitive dust coming from the haul trucks. <br />At the highway coal stockpile, just west of the Bowie No. 1 loadout, no activity was <br />observed.
