SENT BY: ENVIRON DEFENSE;

20-96 11:25AM; 3034408052 => • 303 832 8106; #3/8
believe, in the wuL'ds of FfiV's January letter, "there is no
limit to ti,e MLRB's toleration 'of mining malpractice,"
What is most egregious is Mr. Hartley's avowal that he.
"is nut aware „f any grounds upon which the said Division
would dany the, said application for mining permit."
The said Division, in a Nov. 9 letter, had informed Mr.
Hne•tley: "numerous items have beets identit'ied that need to
be addressed before the application will satisfy the
requirements."
This letter was seven pages long, and detailed 41
inadequacies in Mr. Hartley's permit application. How can
Mr. Hartley state that he is "nut aware" of any grounds for
denying the permit.'
The Durango-Newmineco contract is part of complicnted
business transactions creating a joint venture, partly owned
by Hartley and former Gold Hill Mill manager Wayne Tatman,
created to p,-ocess Mogul Tunnel ore at the Franklin Mill.
near Idaho Springs. In response to a query about hauling
waste ruck from the Mogul Tunnel to the Franklin Mill, the
Division .tnnuary 4, 1996 int'uL~mr.d llartley that Durango's
adequacy L-esponaes for the Mogul Tunnel permit must describe
1) the sourca(s) of the waste rock; '~) the general
characte[-istics of the waste rock: and 3) the destination
and encl use(s) of the waste rock.
A mouth later-, the Division authuL•i~nd Durango to haul
Mogul Tunnel rock iii Franklin fur crushing. Because this
processing is being conducted in the guise of "prospec:tinr;,"
the puhlic is in the dark about whL,t requirements the
Division has set. In view of Durango's pant are processing
record, in particular its prohibited processing of ore at
the Gold Hill Mill, FEV can only pray that the Division and
the Board will exercise the strictest controls aver this
opeL•atiou, inr_luding the destination of Mogul Tunnel rock.
And the FEV urY.es the board, .in cnnsiderLrtion of the
past peLformances of Hartley end 7'atmsn, and to reassure the
public that such mining mnlpractic:e will not be permitted in
the f.'utu[-e, to exact the maximum penalties t'o,- any and every
violation :e 1. the Gold Hill Mill, the fruuklLn Mill, rind the
Mogul Tuuui:l.
Sinr_errr• Ly.
~~~~!~
Park Teter
Cnr,rdiuator, F'!CV
i:i'~ Mike Lnnt•;,
Dirrct.or, DMG
