MINE ID # OR PROSPECTING ID #: M-igR~-naa <br />INSPECTION DATE: a-~-n~ INSPECTOR'S INITIALS: RK <br />The Division conducted a monitoring inspection of the site on 4-5-02, at the request of a citizen's complaint. <br />The site is a 110-construction material located 3 miles East of Divide Colorado, along HIGHWAY 24. On 4-4- <br />02, Mrs. Darlene Johnson, a resident near the gravel pit contacted the Division and raised the following <br />objections regaMing the operators plan to place a temporary asphalt batch plant on site. <br />1) The crushed aggregate for the asphalt batch plant is contaminated with Cyanide, and other metals and <br />is being placed in Trout Creek drainage, because the material for the Asphalt batch plant is being <br />imported from the Cameron pad (M-1991-034 PERMITTED BY CC8eV AND OPEARTED BY CONELLY <br />CONSTRUCTION, WHICH PROCESS AN OLD CYANIDE LEACHED ORE). <br />2) The material from the asphalt batch plant has the potential to contaminate potable source of surtace <br />and ground water. <br />3) Does the operator have the permit from DMG, to operate an asphalt batch plant? <br />She wanted the Division to wnduct an inspection prior to the County hearing date (4-10-02) and let her <br />know if the operator is indeed in violation of his approved permit. She was assured that the Division would <br />conduct an inspection of the site on 4-5-02 and let her know of our findings on Monday 4-8-02. <br />She was informed during the phone conversation on 4-4-02, that even though the material to be used as an <br />asphalC batch plant was from previously leached ore, it was decommissioned and approved for release after <br />it met the material characterization for leach pads, in acwrdance with Mined Land Rules and Regulations <br />and is considered inert. In addition since the asphalt batch plant was going to be in place for NO more than <br />30 days, and in an area already affected and bonded for, it would not require a REVISION SUBMITTAL. She <br />was also informed contrary to what she believes, the material is not from any of the pads that were <br />operated by CC8:V, rather from a pad that was operated by Minerex corporation, that went bankrupt in <br />1985 AND THE PERMIT REVOKED IN 1987. CC&Y acquired the property at a later date and the site was <br />converted to a Construction Materials permit in 1996 to process the leached ore as an aggregate. Since that <br />time, Conley Construction the operator under the CC&V permit has been selling the material to Pioneer sand <br />and Ute sand and gravel. Under Construction material permit, operator does not need an additional permit <br />to transport the material from the site to anywhere in the country. She thanked the Division for the <br />information and asked to be sent, a copy of the inspection report. <br />present during the site inspection were Jerry Johnston the permitee and Larry Medill of Kirkland <br />Construction. There was approximately 40,000 tons of crushed Cameron pad aggregate located in the <br />middle of the already affected pit floor. No material was placed inside the Trout Creek Drainage. The pit <br />floor is sloped towards highway 24 and there is no possibility for any drainage to reach Tout Creek.The <br />Trout creek side also has a berm measuring approximately 7 feet in height. The permit is in compliance with <br />the Division of Minerals and Geology approved reclamation permit. <br />On 4-8-02, contacted Mrs. Darlene Johnson and informed her over the telephone of the above findings and <br />told her a copy of the inspection report will be forwarded to her. <br />
