<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Coal Mine was conducted by Wally Erickson <br />from the DMG Durango office, 484 Turner Drive, Buiiding F, Suite 101, Durango, CO <br />81301, phone (9701 247-5469. Ross Gubka accompanied the DMG inspector <br />throughout the inspection. <br />Mine identification sign and perimeter markers were observed. Mine access roads and <br />haul roads were well maintained. Office and shop facilities areas were clean and well <br />maintained. Fuel storage tanks appeared intact. Spill containment berm, surrounding <br />fuel storage tanks, appeared intact. <br />Operator indicated that Sediment Pond 007 had been recently drained to facilitate <br />maintenance of clay liner. Pond had been dewatered through the standard NPDES <br />discharge location. During the time of this inspection Pond 007 was being refilled, <br />maintenance work completed, no discharge noted. Pit drainage was being pumped to <br />Pond 007. <br />Backfilling and grading of active pit appeared current. Stripping and salvage of topsoil <br />and subsoil appeared current along advancing side of pit. Subsoil and topsoil were <br />winrowed along the reclaimed side of the pit, awaiting redistribution. Side roll irrigation <br />equipment was intact for areas awaiting topsoil replacement. <br />
