III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division <br />of Minerals and Geology. Weather on this day was hot and dry. Ron Thompson <br />represented the operator during review of the public records. <br />Availability of Records <br />The public copy of the mine records is kept at the Tri-State railyard office <br />located along Highway 12 on the west side of Trinidad. The bond document on file <br />with the Division is not on file at the public site. The operator should <br />immediately get a copy of the bond document and place with the public mine <br />records. The results of the records inspection is documented on page 2a of this <br />report. <br />A copy of Permit Revision No. 1 (PR-O1) was found at the Las Animas County Clerk <br />and Recorders Office with a receipt date of June 1, 2001. The required public <br />notice was published in the Chronicle News for the first time on June 4, 2001. <br />The operation is in compliance with Rule 2.07.3(4). <br />Hydrologic Balance <br />Ground water well cluster MW-5 in Alamosa Canyon was visited. The steel casing <br />cap had been removed from well 5C. It was replaced. The water level in well 5C <br />was measured at 123 feet below the top of the steel surface casing. The sound of <br />running water continues to emanate from well 5U. This is likely alluvial water <br />cascading down the annulus of the well, as evidenced by the similar electrical <br />conductivity values between the well and the adjacent Alamosa Canyon flow taken . <br />Given the proposed mine plan, this well should be evaluated for repair or <br />abandonment. <br />General Mine Plan Compliance <br />The mine has yet to commence operations at this time. Permit Revison No. 1 (PR- <br />OD is currently under review. The permit has been extended to May 10. 2002 for <br />commencement of operations. No coal mining activity was noted under this permit. <br />3 <br />
