III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />operator during the inspection. The mine site had a good snow cover which was melting off. Before the <br />Division's inspection began, the operator met with the Bureau of Reclamation representatives to conduct a field <br />inspection of the location where a proposed overhead conveyor would pass over the Fire Mountain Canal for <br />gob pile #3. <br />East Mine <br />The paved haul road was in good condition, with the guard rail in place. The mine ID sign was up at the <br />entrance. There was only a little ice covered water in pond B. The float was attached to the primary pipe. The <br />pond B embankment appeared to be stable. The two collection ditches leading into pond B had sufficient <br />capacity. The coal stockpile at the bottom of the hill was near full capacity for the longwall move. There was no <br />evidence of fugitive dust problems or coal fines being tracked onto the highway. <br />The north facing slope of the main topsoil stockpile was covered in snow and there were no signs of erosional <br />problems on the stockpile. The operator has been experiencing problems with the conveyor belt that leads from <br />the B-seam portal bench up to the D-seam portal bench. The belt has had holes in it and needs to be replaced. In <br />the meantime, some coal fines aze falling onto the D-seam portal bench outslope. This area drains to a sediment <br />pond but the operator will clean up the outslope anyway once the belt is repaired. There was a fairly large <br />amount of stockpiled coal on the D-seam portal bench. <br />Coal Waste Stockpiles <br />The haul road to the coal waste stockpiles was in good condition although there were two small sections of the <br />road that were muddy but passable. The road ditch and berm were functional. The operator put up two sections <br />of silt fence to stop any splashes from haul trucks going onto the outslope. <br />Coal waste stockpile no. 2 was in good condition. The top of the stockpile had positive drainage. The coal refuse <br />was not overly wet and there was no evidence of ponding of water. The coal refuse stockpile outslope also was <br />in good condition with no signs of erosional problems. <br />The drying area between coal refuse piles nos. 1 and 2 was still being excavated. No refuse has been placed <br />there yet. The rate of coal refuse output has decreased significantly since December. <br />Pond D had only a little ice-covered water in it, Pond C had a fair amount of ice-covered standing water, at <br />about the level of the primary discharge pipe. The float was on the pond C primary pipe. <br />Unit Train Loadout <br />There were no rail cars at the Ioadout during the inspection. There was no evidence of fugitive dust in the <br />immediate azea of the Ioadout. Pond J was dry. The pond spillways were functional. The pond embankment <br />appeared to be stable.
