The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted <br />on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. Annual reports, submitted by the operator, indicate that operation has been dormant for several years. <br />However, operator has not filed Notice of Temporary Cessation, as required by Rule 1.13.5. <br />CORRECTIVE ACTION: Submit Notice of Temporary Cessation, in accordance with Rule 1.13.5, for past <br />years of non-production and cessation of mining operations. If operator desires to revise mine status to <br />allow for intermittently active operations, submit Substitute for Notice of Temporary Cessation, as provided <br />by Rule 1.13.7. Submit appropriate notice by October 27, 1997. <br />10/27/97 <br />PB or PV PB <br />TOPIC(S) AR <br />2. Waste rock stockpile terminated along the south bank of Dexter Creek. Evidence of erosion of stockpile, <br />by Dexter Creek flow, was observed. Permit documentation indicates that the stockpile existed prior to <br />permit issuance, however, operator has committed to removal and reclamation of the stockpile. Present <br />location and configuration of the stockpile is not compatible with Rules 3.1.513) and (5) and (10), and <br />3.1.6(11 and (3). <br />CORRECTIVE ACTION: Revise Mining and Reclamation Plans to address removal of the stockpiled material <br />from the channel of Dexter Creek. Revised plans must demonstrate compliance with Rules 3.1.5(3) and 151 <br />and (101, and 3.1.611) and (3). Following DMG review and approval of submitted plans, implement approved <br />plans within 60 days of approval. Mine identification sign and affected area perimeter markers, required by Rule 3.1.12, were not <br />observed. Rule 3.1.12(1) states that identification sign shall be posted at the entrance to the mine site <br />which displays the name of the operator, the permit number, and a statement that a reclamation permit has <br />been issued by the Colorado Mined Land Reclamation Board. Rule 3.1.1212) states that the permit <br />boundaries shall be delineated by monuments or markers. <br />CORRECTIVE ACTION: Ensure that mine identification sign and affected area perimeter markers are posted, <br />in accordance with Rule 3.1 .12, by October 27, 1997. <br />10127/97 <br />CERTIFIED MAIL NO.
