Therefore no assessment is made for this portion. The following is the method used to assess the violations for seriousness and fault: Seriousness - maximum penalty is $1,750 Divided into two components, each with a maximum penalty of $1,750/2 or $875. 1. Probability of damage occurence Divided into four categories each of which are assigned a multiple depending on severity of damage a. damage did occur---------------------------multiple of 4 b. damage is likely to occur------------------multiple of 3 c. damage not likely to occur-----------------multiple of 2 d. damage did not occur or is insignificant---multiple of 1 The damage multiple appropriate to each specific event is multiplied by $875/4 or $218.25 to get a total. 2. Duration and Extent Divided into two components, each with a maximum penalty of $875/2 or $437.50 a. Duration 1. short 45 days--------multiple of 1 2. medium 45-90 days----multiple of 2 3. long~90 days--------multiple of 3 The appropriate multiple is multiplied with $437.50/3 or $145.83 to get a total. b. Extent 1. small---------------multiple of 1 2. medium--------------multiple of 2 3. large---------------multiple of 3 Again the appropriate multiple is multiplied with $437.5013 or $145.83 to get a total.
