<br />III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of <br />Minerals and Geology. No one else was present during the field portion of the inspection <br />Mike Neumann represented the operator during the records check. <br />Snow-pack of more than 2 feet limited inspecting the site. Both entrance gates on County <br />Road 53 were locked. <br />AVAILABILITY OF RECORDS <br />The records checklist is attached. All required records were on-site at the office of the <br />operator's representative. <br />SIGNS AND MARKERS <br />Mine identification signs were properly displayed with the correct information at both <br />gates into the site. Permit boundary markers were also properly displayed. <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds - Both ponds were covered with snow. Pond HG-8 was discharging an <br />estimated 20 gpm of clear water. Pond 003 was not discharging. <br />SLIDES AND DAMAGE <br />As viewed from a distance, no new movement was evident in the slump area on the former <br />south highwall, although part of the area could not be seen due to snow cover. Snow had <br />partially melted from the west side of the permanent overburden dump and no ground <br />instability was evident there. <br />Page 3 <br />
