III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evitlence supportng the enforcement action <br />This was an aerial inspection flown by Harry Ranney of the Colorado Diwsron of <br />Reclamation, Mrning, and Safety (Division). Oblique aerial photographs were reviewed in the <br />office on July 2, 2007 by Kent Gorham of the Division. Thrs former mountaintop removal <br />operation is in the final stages of completing reclamation. The site has achieved a Phase I <br />bond release for most areas. <br />Roads <br />Technical Revision No. 15 (TR-15) approved the relocation of the permanent road through <br />the reclaimed area. The road is now located along the southern portion of the disturbed area <br />until it reaches the saddle between Fill 7 and Fill 8 where heads north and connects with the <br />permanent road heading west and to coal bed methane pads further north. <br />Hydrologic Balance <br />The sediment control system is designed and constructed using shallow grade ditches on <br />steep slopes routed to riprap downdrains that flank the three excess spoil fills at this site. <br />Terrace benches on the fell faces also serve to limit overland flow. Storm runoff eventually <br />enters sediment ponds before any discharge offsite <br />Ponds 6, 7, 8, 9, and 9a were all visible in various photographs taken. All of these ponds <br />held a moderate amount of water Ponds 8 and 9 on the north side of the reined area <br />appeared close to the point of discharging through the primary spillway risers. Any storm <br />runoff in the near future will likely cause these ponds to discharge. <br />3 <br />
