=K <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a partial monthly inspection of the surface facility areas at the Munger Canyon <br />Mine, including the mine disturbance areas in Munger Canyon and the reclaimed Loma <br />Loadout facility. The loadout was inspected at 9:50 a.m., mine area at approximately <br />12:20 p.m. Operator representative Rodney Head was present for the mine site portion of <br />the inspection, but not for the inspection at the Loma Loadout. Weather was clear and <br />cool. Surface areas were moist at Loma and moist to muddy in Munger Canyon. Lodestar <br />Energy, Inc. (LEI) is the official permittee. However, Central Appalachia Mining, LLC (CAM) <br />has been directing and funding operations for some time. A proposed decision to approve a <br />Permit Transfer/Succession of Operations from LEI to CAM was recently issued by the <br />Division, but the decision is not yet final. <br />Signs and Markers <br />Upon final approval of the pending permit transfer, permit I.D. signs at public road entrances <br />to both the mine permit area and the Loma Loadout permit area will need to be replaced. <br />Replacement signs will need to identify Central Appalachia Mining, LLC as the <br />permittee/operator, and provide correct address and phone number information. <br />In addition, certain additional signs and markers need to be erected in the vicinity of the <br />recently constructed coal waste disposal area in Munger Canyon. Permanent perimeter <br />markers need to be erected to define the perimeter of the approved surface disturbance area <br />pursuant to Rule 4.02.3. Stream buffer zone signs need to be erected along the north edge <br />of the topsoil stockpile disturbance and relocated haul road disturbance in the refuse <br />disposal vicinity pursuant to Rule 4.02.5 (marking the buffer along Munger Creek). A <br />topsoil marker sign needs to be placed on the new topsoil stockpile associated with the coal <br />waste disposal site, and a subsoil or cover soil marker should be placed on the cover soil <br />pile, pursuant to Rule 4.02.7. <br />Roads <br />The refuse haul road re-alignment segment in the vicinity of the new coal waste disposal <br />site was recently completed, with the exception of fill slope revegetation and final gravel <br />surfacing, which will still need to be completed. Road width, fill slopes and drainage <br />structures appeared to be in compliance with approved permit. <br />Pre-existing sections of the haul road, and the access road up to the portal bench area <br />appeared to be stable and properly maintained. Road culverts were clear and outlet <br />structures on the upper culverts were in good condition. <br />Hydrologic Balance <br />Drainage and sediment controls at the mine bench area, coal waste disposal site, and the <br />Loma Loadout were in place and in general properly maintained. <br />
