III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on September 2, 2003 by Mike <br />Boulay of the DMG. There were no representatives from Kerr Coal Company present during the <br />inspection. There was no activity at the site. It was cloudy and windy with light rain at the time <br />of the inspection. Ground conditions were mostly dry. <br />Hvdrolo¢ic Balance <br />Sedimentation Ponds C,D,E,F,and G were inspected. None of these site ponds were dischazging <br />at the time of the inspection. Pond C was dry. Ponds D, and E were retaining a significant <br />amount of water, but at a level well below the primary spillway. Ponds F and G were completely <br />dry. The road surface of the permanent light use road was damp, but generally in good condition <br />and well maintained. It appears that some minor grading work has recently been done below the <br />culvert outlet at the inlet to Pond D. No other site activity was appazent since the time of the last <br />inspection. <br />Support Facilities <br />The Surface Facilities Area was well kept. Perimeter areas of the site were inspected and no <br />problems were noted. <br />
