(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-~nm-mF <br />INSPECTION DATE: n6Jv~in~ INSPECTOR=S INITIALS: -IAS- <br />1. An aerial inspection of the Fredstrom Resource was conducted. Several or more oblique photographs of the 266 acre <br />site were taken with a digital camera and will be used by Division staff during future permitting and/or ground inspections <br />to determine compliance with the approved mine and reclamation plan. The photographs are attached to this report. <br />Copies of the aerial photographs will be made available to the operator upon request. <br />2. The status of the Fredstrom Resource is "awaiting warranty". Therefore, a mining and reclamation permit must first be <br />issued by the Division prior to disturbance. The aerial photographs verify that there is no mining disturbance at the site. <br />The operator is also advised to check with the local county government to determine their permitting requirements prior <br />to disturbance. <br />3. The Division approved the Regular 112 Application for the Fredstrom Resource on June 11, 2001 and the amount of <br />financial warranty required was set at $260,500. On April 18, 2003 the Division received an acceptable financial warranty <br />for this amount. The Division then sent correspondence to Aggregate Industries -WCR, Inc. informing them of their <br />need to republish, renotice, and request a reconsideration hearing before the Colorado Mine Land Reclamation Board. <br />The Division considers this matter to be a problem as more than 365 days had lapsed since the application was approved. <br />Rule 4.1(2) requires that if the performance and/or financial warranties are not received within one calendar year of <br />approval of an application for any new permit, amendment or conversion, the Board shall hold a hearing to reconsider the <br />previous approval. Please see page 3 for corrective actions needed to resolve this problem.
