III. COMMENTS - COMPLL4NCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. Jim Kiger <br />represented the operator. <br />Roads <br />The paved entrance haul road was in good condition. The guardrail was in place. The east side <br />entrance graveled road also was in good condition. The light use road along the railroad tracks was <br />passable. <br />Topsoil <br />There was good vegetative cover on the east topsoil stockpile. The collection and diversion ditches <br />were well vegetated and had sufficient capacity. Topsoil signs were up. The west topsoil stockpile also <br />had a good vegetative cover. The collection/diversion berm was functional. Signs were up at this <br />stockpile as well. <br />Facilities <br />There was not much of a stockpile of coal onsite. During the inspection, one coal haul truck was <br />unloading but there was no loading of any railcars. There were no signs of fugitive dust offsite, <br />including on the highway. The operator has been cleaning up the accumulated coal around the railcar <br />loading facility. There were no problems with any of the loadout facilities, substation, wazehouse and <br />mine office. There were no leaks at the fuel facility. <br />Hvdroloev <br />The dugout pond on the west side of the loadout was dry. The spillway and associated riprap were <br />functional. The east side pond was also dry. The primary dischazge pipe valve was closed. The <br />emergency spillway was functional. The pond embankment was well vegetated. Pond inslopes were <br />stable. <br />All of the culverts were cleaz and the ditches had sufficient capacity. The straw bales and silt fence <br />were in place at the railroad small azea exemption. <br />Signs and Markers <br />The mine ID signs were up at the required locations and contained the correct information.
