(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1974-015 <br />INSPECTION DATE 8/22/02 <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Lyons Pit conducted by Erica Crosby of the Division of <br />Minerals and Geology. The operator was not present during the inspection. <br />The purpose of the inspection was to visit the area that encompassed Permit Amendment 6 <br />("AM-006") approved by the Division on May 24, 2000. During the Succession of Operators & <br />and Transfer of Permit process from Western Mobile Boulder, Inc. to Lafarge West, Inc. <br />(approved on July 5, 2002), the Division noticed that the reclamation performance bond for <br />AM-006 was not properly submitted to the Division. On December 21, 2000, the Division <br />received a copy of the Increase Surety Rider for the Lyons Pit. On December 26, 2000, the <br />Division notified the operator that the Division must hold the original Surety Rider at <br />the State Treasury to be able to credit the bond increase to the Lyons Pit. The Division <br />requested the operator to submit the original rider to the Division. The Division never <br />received the original rider. <br />Rule 4.1(2) of the Construction Materials Rules and Regulations states, <br />"No permit may be issued pursuant to the Act until the Board or Office receives and <br />approves the Performance and/or Financial Warranties required herein.
