(Page 2)
MINE ID # OR PROSPECTING ID # M-1974-015
INSPECTION DATE 8/22/02
INSPECTOR'S INITIALS ESC
This was an inspection of the Lyons Pit conducted by Erica Crosby of the Division of
Minerals and Geology. The operator was not present during the inspection.
The purpose of the inspection was to visit the area that encompassed Permit Amendment 6
("AM-006") approved by the Division on May 24, 2000. During the Succession of Operators &
and Transfer of Permit process from Western Mobile Boulder, Inc. to Lafarge West, Inc.
(approved on July 5, 2002), the Division noticed that the reclamation performance bond for
AM-006 was not properly submitted to the Division. On December 21, 2000, the Division
received a copy of the Increase Surety Rider for the Lyons Pit. On December 26, 2000, the
Division notified the operator that the Division must hold the original Surety Rider at
the State Treasury to be able to credit the bond increase to the Lyons Pit. The Division
requested the operator to submit the original rider to the Division. The Division never
received the original rider.
Rule 4.1(2) of the Construction Materials Rules and Regulations states,
"No permit may be issued pursuant to the Act until the Board or Office receives and
approves the Performance and/or Financial Warranties required herein. If these Warranties
are not received within one calendar year of approval of an application for any new
permit, amendment or conversion, the Board shall hold a hearing to reconsider the previous
approval."
Therefore, the Division will schedule this matter for reconsideration of the Division's
decision of approval of AM-006 before the Mined Land Reclamation Board at the October 16-
17, 2002 hearing.
A brief inspection of the site noted that no disturbance has occurred in the AM-006 area.
In addition, on August 27, 2002 the operator submitted an original rider increasing the
financial warranty from $71,250.00 to $1,613,250.00.
I & E ContdCt Address
NAME Mr. Gary Tuttle ^
OPERATOR Lafarge West, Inc. ^
STREET 1590 W. 12th St. ^
CITY/STATE/ZIP Denver, CO 80204 ^
Cc: Carl Mount; DMG (via electronic transmission)
CE
BL
FS
HW
HMWMD (CH)
SE
WQCD (CH)
Mike Hart; Hart Environmental
P.O.
