III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspecfion. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on December 18, 2007 by Mike <br />Boulay of the DRMS. Dennis Jones of Seneca Coal Company (SCC) was present during the <br />entire inspection. Weather conditions were sunny and cold. Ground conditions at the mine site <br />were snow covered. There was no activity at the mine site at the time of the inspection. <br />Roads <br />Only portions of the site were accessible due to snow packed road conditions. Road drainage run <br />outs, road berms and ditches along Haul Roads A and B were all snow covered. Haul Roads A <br />and B were bladed and maintained up to the Dragline Teazdown Area. The North Pit and Ponds <br />011 and O11A were not accessible due to heavily snow packed roads. The North Pit was viewed <br />from the Dragline Teazdown Area and appeazed stable with no signs of erosion or instability <br />noted. <br />Hvdroloeic Balance <br />Sediment Ponds 010, 012, 013, and 014 were inspected. All of these ponds were snow covered. <br />Ponds 010 and 012 were full and discharging. Ponds 013 and 014 were retaining water but not <br />dischazging. Embankments and discharge structures were stable at all of these pond locations. <br />The slide azea above Pond 012 was viewed from the Pond 012 embankment. The crack and azea <br />of continued instability is visible through the snow about midway up the slope above the pond. <br />SCC is continuing to work towazds stabilizing the slide azea. <br />
