As you are aware, two problems were cited in our May 6, 2004 inspection report for the Deer Creek
Quarry. Problem 1 involves the adequacy of spill containment of the fuel tank in the equipment area.
Problem 2 concerns spill containment for steel drums containing toxic chemicals {anti-freeze). The
original "correction date" for both problems was July 25, 2004.
At your request, the correction date for problem 1 was extended to October 23, 2004, as noted in the
Division's approval letter dated August 4, 2004. No extension was requested for problem 2.
In follow-up to our October 28, 2004 telephone conversation, the Division of Minerals and Geology will
consider problem 1 resolved pending final development of the Division spill plan policy.
Also pursuant to our October 28, 2004 telephone conversation, resolution of problem 2 is not contingent
upon this policy. As such, its correction date remains as July 25, 2004.
To avoid potential future enforcement actions for non-compliance with State statutes, Rules and
Regulations, and/or conditions specified in your permit for this site, please submit documentation of
compliance with the specified corrective action to our office by November 19, 2004.
