III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspectioa. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented <br />the operator during the records check and the Feld inspection. The ground was frozen in the morning <br />but began to thaw by noon. Most of the site was free of snow. In spite of rock fall problems in the <br />mine, the mine is still producing coal, although at a reduced rate. <br />Main Mine <br />The main paved haul road was in very good condition. The guardrail was in place. Road ditches and <br />culverts were functional and ditch riprap was intact. The mine ID sign was up at the entrance and <br />contained the correct information. Surface disturbance markers were up around the mine site. <br />There was only a small amount of coal on the coal stockpile bench. The berm on the outer edge of the <br />stockpile bench was functional and there were no signs of fugitive dust offsite. The culverts and <br />ditches in this area were functional. However, the grate at the inlet of the main road culvert close to the <br />engineering building will need cleaning soon. Across the main highway, there was only a little ice- <br />covered water in pond B. The pond embankment was stable and the pond spillways were operational. <br />The float was attached to the free end of the primary discharge hose. The gated primary discharge <br />valve was closed. The culverts and ditches bringing runoff into pond B were functioning. <br />There were no erosional problems at the main topsoil stockpile. Diversion and collection ditches were <br />functioning as designed. The topsoil stockpile signs were up. There were no problems at the material <br />storage area next to the topsoil stockpile. <br />At the B-seam portal bench, the operator has constructed a concrete wall and drainage system to keep <br />material and runoff from flowing or falling onto the outslope of the portal bench. The cut slope above <br />the portals appeared to be stable. The B-seam excess material storage stockpile also appeared to be <br />stable. There were no indications of slope failure or erosional gullying. <br />There was almost no coal stockpiled on the D-seam portal bench. There were no signs of gullying or <br />slumping on the portal bench outslope. The berm was up on the outside edge of this portal bench. <br />Culverts in this area were clear and ditches had sufficient capacity. There were no problems at the fuel <br />barn or at the material storage area on the bench. However, at the upper material storage area, several <br />unopened containers of glue had been stored and these probably should be stored in a more secure <br />azea. The doors on the cap and powder houses were double locked. <br />There was snow cover on the utilities bench. The road leading up to this bench was in good condition, <br />with the berm on the outside edge of the road. There were no indications of movement with the rock <br />catchment berm. The topsoil stockpile on this bench was covered in snow. The topsoil sign was up. <br />The cut slope above the wash plant was stable. The operator was moving refuse from the wash plant to <br />gob pile no. 2. The culverts and ditches around the wash plant were functional. <br />
