(Page 2) <br />MINE ID # OR PROSPHCTING ID # M-76-032 <br />INSPHCTION DATE 12-17-97 INSPECTOR'S INITIALS SSS <br />This was a routine monitoring inspection conducted as part of the Division's four-year <br />inspection program. <br />The operator indicated that there was still no resolution in writing from the Forest Service, <br />for corrective actions required in the area where the operator conducted mining operations <br />on USFS property without right-of-entry. Corrective actions and civil penalties ordered by <br />the Mined Land Reclamation Board in Notice of Violation No. M-93-017 are still pending. <br />Resolution of the Board Order requires documentation from the Forest Service granting the <br />operator a right to mine the property or right-of-entry to reclaim the site. The operator <br />stated that the Forest Service has indicated the plan will be in place for an early March <br />1998 start on work to reclaim the USFS area. The operator needs to be aware that revisions <br />to Permit No. M-76-032 may be required before any work to reclaim the USFS property disturbed <br />by the mining operation may begin. The Division will need time to review any proposed <br />revisions before they are implemented. <br />The operator indicated that they have verbal approval from the Forest Service to begin <br />dumping fill material on the USFS land to reconstruct a flood plain at the confluence of the <br />San Miguel and South Fork Rivers. There are many truckloads of material dumped on the site <br />at this time. The operator is also stockpiling stumps on site for use in stream bank <br />revetment when the USFS environmental assessment process is completed. <br />The tailings excavation area on the upper San Miguel River appears to have been completed and <br />smooth graded as required by the approved reclamation plan. The operator is in the process <br />of removing this area from their permit with the county and have indicated that they will <br />request release of this area from Permit No. M-76-032 upon completion of the county process. <br />The reclamation bond is adequate at this time because reclamation of the tailings excavation <br />area and some of the wash plant settling ponds has occurred without a warranty reduction <br />taking place.
