<br />IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and date of <br />abatement for the violation, previous violations still requiring abatement and the termination of violations <br />cited during previous inspections. <br />No evidence was observed indicating recent progress towards reclamation of the site, or <br />attempts to control weed infestation, or attempts to ensure prompt establishment of a <br />protective vegetative cover for areas where topsoil redistribution has occurred. <br />Observations made by DMG indicate that topsoil redistribution activities ceased during <br />the late summer or early fall season of 1999. Therefore, the operator has had two <br />opportunities to seed and plant the appropriate areas, during the fall 1999 and spring <br />2000 seasons. However, DMG records do not indicate that the operator has attempted <br />to seed the portions of the rock fill area where topsoil has been redistributed, or the <br />topsoil stockpile #2, partially disturbed by the topsoil redistribution. The operator is <br />strongly encouraged to 1) employ appropriate weed control methods; 2) grade the <br />partially disturbed topsoil stockpile #2 to stable slopes necessary to promote <br />establishment of a protective vegetative cover; and 3) not disregard the opportunity to <br />plant and seed all areas where topsoil redistribution has occurred and the partially <br />disturbed topsoil stockpile #2, during the fall 2000 season. <br />Failure to promptly establish an appropriate vegetative cover, following topsoil <br />redistribution, may result in violation of Rule 4.15.1(1-, 121 and 12)Ib). Failure to <br />establish a protective vegetative cover of non-noxious weeds at the partially disturbed <br />topsoil stockpile may result in a violation of Rule 4.06.312-(a)(i1. Failure to protect <br />topsoil from wind and water erosion and failure to minimize deterioration of the <br />biological, chemical and physical properties of the topsoil, during redistribution and <br />before and after it is seeded and planted, may result in violation of Rule 4.06.4(2)(c) and <br />Id). <br />No enforcement actions were taken as a result of this inspection. However, failure to <br />comply with the weed control, revegetation and topsoil protection issues identified <br />within this report may result in enforcement action. <br />NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br />Revised 2/97 <br />m:\coel\share\forms\a 101 <br />
