IV. ENFORCEMENT ACTIONS
The following identifies enforcement actions taken during this inspection, the required abatement and date of
abatement for the violation, previous violations still requiring abatement and the termination of violations
cited during previous inspections.
No evidence was observed indicating recent progress towards reclamation of the site, or
attempts to control weed infestation, or attempts to ensure prompt establishment of a
protective vegetative cover for areas where topsoil redistribution has occurred.
Observations made by DMG indicate that topsoil redistribution activities ceased during
the late summer or early fall season of 1999. Therefore, the operator has had two
opportunities to seed and plant the appropriate areas, during the fall 1999 and spring
2000 seasons. However, DMG records do not indicate that the operator has attempted
to seed the portions of the rock fill area where topsoil has been redistributed, or the
topsoil stockpile #2, partially disturbed by the topsoil redistribution. The operator is
strongly encouraged to 1) employ appropriate weed control methods; 2) grade the
partially disturbed topsoil stockpile #2 to stable slopes necessary to promote
establishment of a protective vegetative cover; and 3) not disregard the opportunity to
plant and seed all areas where topsoil redistribution has occurred and the partially
disturbed topsoil stockpile #2, during the fall 2000 season.
Failure to promptly establish an appropriate vegetative cover, following topsoil
redistribution, may result in violation of Rule 4.15.1(1-, 121 and 12)Ib). Failure to
establish a protective vegetative cover of non-noxious weeds at the partially disturbed
topsoil stockpile may result in a violation of Rule 4.06.312-(a)(i1. Failure to protect
topsoil from wind and water erosion and failure to minimize deterioration of the
biological, chemical and physical properties of the topsoil, during redistribution and
before and after it is seeded and planted, may result in violation of Rule 4.06.4(2)(c) and
Id).
No enforcement actions were taken as a result of this inspection. However, failure to
comply with the weed control, revegetation and topsoil protection issues identified
within this report may result in enforcement action.
NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS
Revised 2/97
m:\coel\share\forms\a 101
